A New South Wales law has been tested – a law on determining how sex is represented on birth and death registrations.

Sydney resident Norrie May-Welby, who wants to be recognised as being of non-specific sex, sparked the case by requesting to be termed “not-specified” on all records.

This isn’t the first time that Norrie has applied for a certificate – they were sent one by the NSW Registry of Births, Deaths and Marriages in 2010, but they soon cancelled it.

In response, a complaint was filed with the Australian Human Rights Commission – leading to the High Court case yesterday.

Anna Brown’s the Director of Advocacy and Strategic Litigation of the Human Rights Law Centre and was with me to look at this ruling and the implications it has for other states…
